Booking & Cancellation

Portrait photography sessions are payable at the time of booking. A booking is considered firm as from the date of payment. Accordingly Nemi Miller will, at her discretion, accept cancellations and issue a refund depending on the amount of notice received prior to the agreed date: More than 5 working days 75% refund, 3-4 working days 50% refund, 48 hours 25% refund. Cancellations with less than 24 hours notice will not receive a refund. 

Fulfilment of Obligations

There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject. As a creative artist, Nemi Miller will aim to select up to 30 images for your viewing and ordering session.

Pricing

Prices are subject to change at anytime and you will be notified by an email about any changes to the current prices.

Retouching of images

All retouching work will be in line with my usual editing style. I use professional retouchers who hand edit your images in a natural style as seen on my website. Retouching of images outside of my own style might be available as long as it still represents my work as seen on my website. 

There will be an additional charge for retouching of tan lines, stray or messy hair, radical wrinkle removal, drastic slimming and any face swaps. 

A quote will be issued before any extra work begins and the customer will settle the outstanding invoice at the time of order.

The Client understands that no unedited images or RAW files will be released at any time.

Maternity Masterpieces

Maternity Masterpieces are created using the flowing fabrics captured during your session. Each Masterpiece is an individual work of art in the style of images represented on my website. Due to the complexity and time involved working on each image, the client is entitled to no more than 1 revision under the terms of this agreement. If additional revisions are requested, clients will be responsible for further retouching fees. Those will be quoted before work begins. 1 Maternity Masterpiece is included with each session.

Use of Images

Nemi Miller respects your right to privacy. If you do not wish  for Nemi to feature your images on her website, blog or on social media sites please make your wishes be known.

Delivery of Products

The supply of products and services are provided by the Photographer on a best endeavours basis. The Photographer will not be liable for delays that are beyond her reasonable control. The Photographer shall use reasonable endeavours to meet agreed deadlines where applicable. The Photographer shall not be liable for any delays in meeting any of her obligations which were due to causes beyond her reasonable control including but not limited to; postage/courier/lab delays, war/acts of terrorism, riots, government legislation, industrial action, adverse weather conditions, acts of God, floods, fire, loss or damage in transit etc.

 Rush Services

The Photographer reserves the right make an additional charge should the Client request a rush service. This service is subject to availability and cannot be guaranteed.

Receipt of portraits, products or wall art

All orders are presumed to have been received in good condition unless the client notifies Nemi Miller in writing of any discrepancy or error within 14 days of receipt.

Unordered Images

All images which have not been ordered will be transferred into an archive three months after your session. Storing of images and retrieving images from storage will incur a £100 fee. 

Cooling off period

All portraits, books, albums, frames are non-refundable. Orders cannot be cancelled due to the custom nature of the products. Orders are made to the client’s personal specification, (i.e. image number, print size, frame style, etc.), the client does not have the right to a cooling off period. By placing an order with Nemi Miller you are committing to buy the ordered products.

Returns policy

Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the client. Returns will not be considered for incorrectly ordered items or items ordered in error.

Copyright & Reproduction

Copyright is retained by Nemi Miller at all times. No image can be copied, scanned or reproduced in any form whatsoever without the prior consent of Nemi Miller. The client may not alter or add to or manipulate a picture by any means without Nemi Millers’ written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the client by Nemi Miller only when digital negatives are purchased and paid in full by the client to Nemi Miller.

Additional

Cameras, mobile phone cameras and camcorders are not permitted during any session, in studio or on location without permission from Nemi Miller.

Nemi Miller (Photographer) shall not be liable to the client for any failure, in whole or in part, to fulfil her obligations where failure arises as a result of an event or circumstances beyond her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. Special requests are not binding instructions although every effort is made to comply with the client’s wishes. In the unlikely event of total photographic failure or cancellation of the contract by Nemi Miller's liability shall be limited to a full refund of all monies paid.
